§ 1 Booking/Registration and Conditionsa) The Site is available only to individuals and entities that can form legally binding contracts under applicable law. Without limiting the foregoing, the Site and the services offered by the Site are not available to minors. If you do not qualify, you may not use the Site. You warrant that you are eighteen (18) years of age or older to reserve a room on this Site. If you are under the age of eighteen, you may contact the hotel directly for assistance. b) Already with the application, the number of person and the number of accommodations must be announced not later than 5 working days before the arrival. c) After registering via the online form or by email, the guest/participant will receive the invoice by email. The guest/participant has to pay the invoice 100% within the period stated on the invoice. Payment is made by transferring the amount to the organiser’s bank account, which is stated on the invoice. The organiser holds the open position for the client until the expiry of the payment deadline. If the invoice is not paid on time, the organiser cancels the registration. Payment pursuant to an overdue invoice is not possible and the organiser is not obliged to ensure another open position to the client. d) The management of the ZENKLAUSEN reserves the right to change the prices in all areas. Prices may also be changed by the management if the customer later wishes modifications in the number of reserved rooms, benefits of the stay, attendance, or the length of stay and as long as the management of ZENKLAUSEN in the Eifel agrees on it. e) In principles the ZENKLAUSEN accepts only applications by e-mail or on the Internet at www.zenklausen.com. In exceptional cases, an application by fax or phone is possible after consultation with the Executive Committee. Each registration is binding. The contract comes only with electronic (e-mail) or written confirmation from the management of ZENKLAUSEN. The automatically generated reply which is generated by filling in the on-line form and/or registration form is not a binding confirmation in the above sense. f) All events are open to the public; nevertheless the ZENKLAUSEN reserves the right to refuse registrations without stating reasons therefore. g) The applicant is responsible for the completeness and accuracy of its information. This applies also for the applicant's services and expenses for third parties. By registering, the registrant explains that he/she agrees to the Terms, Privacy and Conditions of the ZENKLAUSEN on behalf of the co-pending Visitors. Guest's liability for their account is not waived and guests agree to be held personally liable in the event that any indicated person, group, company or association fails to pay all or part of any charges incurred. h) On the agreed day of departure the room(s) of the ZENKLAUSEN should be emptied until 11:30 clock (a.m.). Afterwards, the management of Zenklausen charges until 18:00 clock 50%, and from 18:00 clock 100% of the full accommodation prices. i) Reserved rooms are available to the guests/participants at the arrival day from 17:00 clocks onwards. The guests / participants have no right for earlier availability. Check in hours are accepted between 15:00 to 16:00 clocks on the day of arrival. j) Gift coupons are issued after receipt of payment. The purchased of gift coupons cannot be exchanged for cash or refunded. Furthermore, these must be exchanged within the given period. If the use is less than the value of the coupon, you will receive a further gift coupon from the Zenklausen over the remaining amount. The gift coupon contain VAT. The gift coupon is only valid when the amount has been paid in full. All gift coupons are valid for one year and can be exchanged during this period. § 2 Cancellation, Changes, Rebooking, Feesa) We charge a processing fee of €30 for all cancellations (up to 14 days before arrival) and/or rebookings. When rebooking, an alternative date can be chosen within 6 (six) months, starting from the original arrival date. Furthermore, if an agreed registration is canceled within the 4 (fourth) weeks before the respective stay/participation, 75% of the participation and residence fee will be refunded. From the 3 (third) week before 50%. Within the last 2 (two) weeks before the start of the stay or course, no refund of the participation fee and residence fees is possible. There is also no entitlement to a refund of the fee if a stay is broken off prematurely. There will also be no reimbursement for canceled or missed hours.
b) In the event of a rebooking and subsequent cancellation, the higher cancellation costs will apply in addition to the rebooking fee, regardless of whether this relates to the original date or the rebooked date. c) Prices under the contract are to be paid by the customer even if the customer does not make use of the services. d) The management of ZENKLAUSEN reserves itself the right, in case of majeure forces or for reasons that are not in its area of responsibility to cancel the respective event/booking. e) In the case of complete cancellation of an event due to bad weather or unforeseeable, the organizer reserves the right to retain 50% of the registration fee as a contribution towards expenses. |
§ 3 Othersa) In the ZENKLAUSEN the facilities for private room telephone, internet, television, radio and newspapers are not provided. You have retreated yourself to a place of tranquility and leisure.
b) The ZENKLAUSEN reserve the right to charge guests the cost of rectifying damage, caused by the deliberate, negligent or reckless act of the guest to the ZENKLAUSEN’s property or structure. Should this damage come to light after the guest has departed, we reserve the right to make a charge to the guest’s credit/debit card, or send an invoice for the amount to the registered address. We will however make every effort to rectify any damage internally prior to contracting specialists to make the repairs, and therefore will make every effort to keep any costs that the guest would incur to a minimum. c) THE ZENKLAUSEN reserve the right to charge guests the cost of replacing any items that are removed from the premises by them without consent. The charge will be the full replacement amount of the missing item, including any carriage charges. Should the fact that the item is missing come to light after the guest has departed, we reserve the right to make a charge to the guests credit/debit card, or send an invoice for the amount to the registered address. d) It is the ZENKLAUSENS’s policy that all our guests have the right to be treated with dignity and respect and as a responsible host we believe that we have a duty to our guests to protect them from inappropriate behaviour. Should any actions by a guest be deemed inappropriate by the Duty Manager, or if any inappropriate behaviour is brought to the attention of the Duty Manager, the ZENKLAUSEN reserves the right, after any allegations have been investigated, to take action against the guest. Depending on the severity of the guest actions, the Police may become involved at the ZENKLAUSEN’s discretion, or guests may be asked to leave the ZENKLAUSEN. d) All speakers and participants at the event(s) are themselves responsible for their words, actions and decisions. Each individual decides for himself which event to attend, what (how and how much) he will gain from attending it and what his experience will be. e) The organiser and the speaker do not provide any warranty or guarantees for any kind of improvements of personal situations, health or wellbeing from attending the event(s) and utilisation of knowledge, ideas or advice presented at the event(s). In any case, every participant is himself responsible for the participation at an individual event, his health, wellbeing and the utilisation or non-utilisation of acquired knowledge and the observance or non-observance of the ideas or advice provided by the speaker. f) The organiser shall not be liable for any injuries or damage to or loss or destruction of the client’s belongings and the belongings of those participating at the event(s) due to fire, storm, hail, lightning, theft, water damage, other accidents, illness, third party actions or any other cause. All insurance against these cases shall be handled by every individual himself. e) For cases of illness and/or cancellations during your stay, we ask you to obtain adequate insurance in advance. f) All vehicles are parked at the owners’ risk. Should a problem occur with a vehicle in the ZENKLAUSEN car park, the ZENKLAUSEN cannot accept any liability. g) All relations between the clients, participants and the organiser are subject to the legal order of the Republic of Germany. All sides shall endeavour to solve any eventual disputes amicably. If this is not possible, the disputes shall be solved by the competent court in Germany. h) With the purchase, registration or attendance, the client or the participant agrees that he is fully familiar with these General Terms and Conditions and that he/she accepts them. § 5 Copyrighta) The published information on these pages are subject to the Law of Copyright. The reproduction, editing, distribution and any kind of exploitation outside the limits of the copyright law requires the written agreement of the originator. Contents contributed by third parties are marked as such. Downloads and copies of these pages are permitted for private use only. The commercial use of our content without the agreement of the originator is illegal. The names, trademarks, service marks and logos appearing on this site may not be used in any advertising or publicity, or otherwise to indicate ZENKLAUSEN's
sponsorship of or affiliation with any product or service, without ZENKLAUSEN’s prior express written permission. b) Even if the Zenklausen is basically open-minded and interested in commercial recordings and filming, we place great value on the influences and scope of the planned recordings which may influence the privacy and discretion of our house and guests. Thus, for all commercial shootings, production, and shooting, both photographic, acoustic and especially cinematic recordings must be requested from the responsibility of the Zenklausen. A written production request (by mail) is necessary for issuing a license agreement. The request must inform the responsible producer (authorizing authority), provide explanations of the planned production process and the subsequent use. It is necessary to appoint a responsible employee of the production, who supervises on the spot compliance with the authorizations and implements orders of the Zenklausen reliably.
